2. PARKING
(c.) Article IX, Section 2 of the Declaration of the Covenants, Conditions, Restrictions, and Easements of the Community of Lotus Creek states that ”…no boat, boat trailer, house trailer, trailer, or any other similar items shall be stored or parked in, upon or adjacent to any Lot, unless the same is stored in a garage or other approved enclosure…”
Lotus Creek has adopted the City of Virginia Beach Code section 16-41.2 regarding equipment parked in a driveway or approved parking area for a period not to exceed 24-hours for loading and unloading. Additionally, the aforementioned items from Article IX, Section 2 may not be brought into the community more than twice (2 times) in a seven (7) day period.
RVs belonging to residents will be allowed only for loading and unloading for trips and must never block roads or another resident’s property. Any of the aforementioned items, from Article IX, Section 2 of the Declaration of the Covenants, Conditions, Restrictions, and Easements of the Community of Lotus Creek, brought in to the community for a period exceeding 24 hours will be subject to the following:
Any of the aforementioned items, from Article IX, Section 2 of the Declaration of the Covenants, Conditions, Restrictions, and Easements of the Community of Lotus Creek, brought in to the community for a period exceeding longer than 24 hours will be subject to the following:
- The violation will be reported to the City of Virginia Beach Code Enforcement as soon as the 24 hour period has expired. The Association will request the City to require immediate enforcement and/or removal.
- The Association will notify the owner, at his last known address provided to the Association, of this violation and given 24 hours to cure this violation.
- If the violation is not cured within 24 hours, the Association will notify the owner of a hearing to be held, pursuant to Article V, Section 4 of the Declaration and Article IX, Section 13 of the Declaration. Said notice will be provided by hand-delivery or registered or certified mail, return receipt requested, at least 14 day prior to meeting. At the hearing, the owner may be represented by counsel. Within seven (7) days of the hearing, the result will be will be provided by hand-delivery or registered or certified mail, return receipt requested.
- As stated in the Association By-Laws Article 9.1f – g Compliance & Default, the Association will proceed with a hearing process once the 24 hours has expired, which could result in the homeowner’s account being assessed $50 per occurrence.
